Measures for the Recognition of High-Level Talents in the Guangdong-Macao In-Depth Cooperation Zone in Hengqin

Article 1.

Purpose of the Measures

Pursuant to the Master Plan for the Construction of Guangdong-Macao In-Depth Cooperation Zone in Hengqin, the Interim Measures for the List-Based Administration of High-End and Sought-After Talents Eligible for Preferential Individual Income Tax Policies in the Guangdong-Macao In-Depth Cooperation Zone in Hengqin, and the Several Measures for Supporting Talent Development in the Guangdong-Macao In-Depth Cooperation Zone in Hengqin, these Measures are hereby formulated to attract and gather top international talents and to establish a robust managing system for the recognition and service of high-level talents.

Article 2.

Scope of Applicability

The term “high-level talents” in these Measures refers to distinguished talents, leading talents, top-notch talents, and young talents as identified based on the Classification Standards for High-Level Talents in the Guangdong-Macao In-Depth Cooperation Zone in Hengqin (see attachment).

The Classification Standards for High-Level Talents in the Guangdong-Macao In-Depth Cooperation Zone in Hengqin are formulated by the Economic Development Bureau of the Guangdong-Macao In-Depth Cooperation Zone in Hengqin (hereinafter referred to as the “Cooperation Zone”) and are subject to timely adjustments and dynamic updates based on economic and social development as well as talent demand.

Article 3.

Recognition Principles

The recognition of high-level talents shall adhere to the principles of moral integrity and professional competence, fairness and impartiality, performance-based evaluation, and contribution to development.

Article 4.

Recognition Criteria

The recognition of high-level talents is not subject to nationality, household registration, or identity.

In addition to meeting the conditions specified in the Classification Standards for High-Level Talents in the Guangdong-Macao In-Depth Cooperation Zone in Hengqin, high-level talents must also meet the following conditions:

1. Abide by laws and regulations and support the “One Country, Two Systems” policy;

2. Demonstrate integrity and uphold high professional ethics;

3. Have achieved outstanding performance with professional expertise at the forefront of their industry;

4. Work full-time at an employer (enterprise or institution) that substantially operates within the Cooperation Zone (excluding personnel with established positions in the Party and government entities and intuitions managed with reference to the Civil Servant Law);

5. Distinguished talents shall generally be under 70 years of age; leading talents under 60 years of age; top-notch talents under 55 years of age; and young talents under 45 years of age. Age restrictions may be relaxed for urgently needed and scarce high-level talents.

Article 5.

Special Provisions for Recognition of High-Level Talents Introduced from Macao Special Administrative Region

“High-end talents” and “outstanding talents” as recognized under Law No. 7/2023 of the Macao Special Administrative Region (“The Legal System for Talent Recruitment”) may apply for recognition as high-level talents in the Cooperation Zone, provided that they are employed by either Macao companies with affiliated relationships with enterprises in the Cooperation Zone or employers with substantial operations in the Cooperation Zone, and spend a minimum of 90 days per year working and residing in the Cooperation Zone.

Article 6.

Implementation

The Economic Development Bureau of the Cooperation Zone will be responsible for implementing the recognition work of high-level talents, lead the formulation of relevant policies and measures, and coordinate the resolution of major issues.

Article 7.

Procedures of Recognition

Applications for high-level talents recognition are accepted year-round and follow the process outlined below:

1. Application: The applicant submits a recognition application to the employer and provides relevant supporting materials;

2. Review: The employer reviews the applicant’s qualifications;

3. Recognition: The employer recommends eligible distinguished, leading, top-notch, or young talents who meet the “Recognition Standards for High-Level Talents in the Guangdong-Macao In-Depth Cooperation Zone in Hengqin” and submits the application materials to the Economic Development Bureau of the Cooperation Zone for recognition;

4. Certification: The Economic Development Bureau of the Cooperation Zone issues the corresponding level of talent card to approved applicants.

Article 8.

Dispute Resolution

Should a dispute arise regarding a recognition result, the applicant may request reconsideration by the Economic Development Bureau of the Cooperation Zone, and the applicant’s employer shall cooperate with the Economic Development Bureau during the reconsideration process.

Article 9.

Application of Recognition Results

High-level talents recognized under these Measures who also meet the conditions specified in Article 3 of the Interim Measures for the List-based Management of High-End and Sought-After Talents Eligible for Preferential Individual Income Tax Policies in the Guangdong-Macao In-Depth Cooperation Zone in Hengqin (hereinafter referred to as the “Interim Measures”) shall be identified as “high-end talents” as defined in Paragraph 1, Article 4 of the Interim Measures. These recognized high-level talents shall be included in the list-based management system and enjoy individual income tax benefits. In addition, these high-level talents are entitled to other services and benefits in accordance with the relevant regulations of Guangdong Province and the Cooperation Zone.

Article 10.

Recognition Period and Management Requirements

The recognition period for high-level talents is five years, and re-recognition applications must be submitted within three months prior to expiration.

After recognition, high-level talents who meet the criteria for a higher category may apply for re-classification to the corresponding talent category.

If a recognized high-level talent ceases to work within the Cooperation Zone, either the individual or the employer shall report to the Economic Development Bureau of the Cooperation Zone at least one month prior to the termination of employment.

The Economic Development Bureau, in coordination with relevant industry departments, shall strengthen ongoing and post-recognition supervision, conduct random checks on the actual work of high-level talents in the Cooperation Zone, and enhance risk assessment and response.

Article 11.

Legal Liability

If applicants engage in fraudulent practices during the high-level talent recognition process, their qualification shall be revoked. The applicants shall also be disqualified from reapplying for high-level talent benefits in the Cooperation Zone and required to return any benefits already received. If suspected illegal or criminal activities are involved, the competent authorities shall pursue legal liability in accordance with the law.

If an employer assists in providing false documentation or review opinions, and such actions constitute suspected illegal or criminal activity, the competent authorities shall pursue legal liability in accordance with the law.

Under any of the following circumstances, the title of high-level talent shall be revoked:

1. Engaging in actions that harm national sovereignty, security, or development interests;

2. Engaging in academic or performance fraud;

3. Providing false materials to fraudulently obtain high-level talent qualifications;

4. Committing major acts of dishonesty;

5. Receiving criminal penalties;

6. Other circumstances that contravene national policy directives.

Article 12.

Right of Interpretation

The Economic Development Bureau of the Cooperation Zone reserves the right to interpret these Measures.

Article 13.

Effective Date and Validity Period

These Measures shall come into force on April 1, 2024, and remain in force until December 31, 2025.

Individuals who meet the eligibility criteria of these Measures after January 1, 2023, may apply in accordance with the provisions herein.

High-level talents recognized during the validity period of these Measures shall continue to comply with the management requirements specified in Article 10 for the remainder of their recognition period, even after the expiration of these Measures.

1. Recipients of the Nobel Prize (in Physics, Chemistry, Physiology or Medicine, Economics, Literature), the Copley Medal, the Turing Award, the Fields Medal, the Abel Prize, the IMU Abacus Medal (formerly Nevanlinna Prize), the Carl Friedrich Gauss Prize, the Chern Medal, the Crafoord Prize, the Wolf Prize, the Lasker Award, the Shaw Prize, the Kyoto Prize, the Albert Einstein World Award of Science, and the Pritzker Prize.

2. 5. Recipients of the National Medals and National Honorary Titles of China, recipients of the Grand Bauhinia Medal of the Hong Kong Special Administrative Region Government, and recipients of the Honorable Medal of Grand Lotus Flower of the Macao Special Administrative Region Government.

10. Founders of National Manufacturing Single Champion Enterprises (including enterprises with champion products), key “Little Giant” enterprises specializing in niche sectors, and Unicorn enterprises; founders or R&D leaders of entities holding marketing authorization for Class I new drugs; founders or R&D leaders of enterprises designated as “Chain Leaders” in the key industrial chains of Guangdong Province’s Strategic Pillar Industrial Clusters (limited to two applicants per entity).

11. Current or former holders of positions at the level of United Nations Assistant Secretary-General or Assistant Director-General of United Nations specialized agencies and above; current or former judges of the International Court of Justice of the United Nations, judges of the World Trade Organization Appellate Body, or holders of equivalent or higher positions.

12. Current or former holders of positions at the level of Executive Director of the United Nations World Tourism Organization and above; current or former senior management personnel at the continental headquarters of international hotel brand management companies.

13. Current or former senior management personnel at the headquarters of the Global Association of the Exhibition Industry (UFI), the International Congress and Convention Association (ICCA), or the International Association of Exhibitions and Events (IAEE) who have held positions of Chief Executive Officer, Chief Operating Officer, or above; Chairpersons of Continental Committees or Chairpersons of China Committees of these associations.

14. Current or former members of the top management of the International Monetary Fund (IMF), the World Bank, the World Trade Organization (WTO), the Bank for International Settlements (BIS), the Asia-Pacific Economic Cooperation (APEC), the Asian Development Bank (ADB), the Asian Infrastructure Investment Bank (AIIB), the Shanghai Cooperation Organization, or the Boao Forum for Asia.

15. Senior management personnel at the headquarters of internationally renowned financial institutions such as Goldman Sachs, Morgan Stanley, JPMorgan Chase, Citibank, Société Générale, and Deutsche Bank; senior management personnel at the headquarters of internationally renowned accounting firms such as PricewaterhouseCoopers (PwC), Deloitte & Touche, Ernst & Young (EY), and KPMG; or senior management personnel at the headquarters of accounting firms ranked within the top ten nationally as published by the Chinese Institute of Certified Public Accountants in the past five years.

16. Presidents and Chair Professors of world-renowned arts institutions such as the Juilliard School, Yale School of Music, Royal College of Art, Pratt Institute, ArtCenter College of Design, and New York Film Academy; or chief conductors and artistic directors of world-renowned orchestras such as the Berlin Philharmonic, Vienna Philharmonic, London Symphony Orchestra, and Russian National Orchestra.

Individuals who, in the past five years, have served as Chairpersons, General Managers, or chief-level executives of enterprises in key industries such as integrated circuits, biomedicine and health, new-generation information technology, new energy, new materials, and financial technology, who have had substantial influence in the industry, possess management capabilities to introduce strategically important and major projects, or hold scientific and technological achievements at or above the domestic leading level, and can play an indispensable role in industrial innovation in the Cooperation Zone, or have significantly promoted the socio-economic benefits of the development of the “Four New” industries in the Cooperation Zone.

Current or former Vice Chairpersons, Vice Presidents, or Deputy General Managers of the headquarters of companies listed in the Fortune Global 500 (Fortune or Fortune China, Forbes or Forbes China, Hurun Global Rich List), China’s Top 200 Enterprises (Fortune or Fortune China, Hurun China Rich List, China Enterprise Confederation List), or China’s Top 50 Most Innovative Companies (Forbes or Forbes China List), or principal leaders of first-level subsidiaries (regional divisions) directly under the headquarters (limited to two applicants per company).

10. Founders of “Little Giant” enterprises specializing in niche sectors or potential unicorn enterprises recognized by the Guangdong-Macao In-Depth Cooperation Zone in Hengqin; founders or R&D leaders of enterprises designated as “Chain Leader Enterprises” in the key industrial chains of Guangdong Province’s Strategic Emerging Industrial Clusters; founders or R&D leaders of entities holding product registration certificates for Class III medical devices that have entered the National Medical Products Administration’s special review process for innovative medical devices and obtained product registration certificates (limited to two applicants per entity).

11. Directors, Deputy Directors, or Chief Physicians of departments ranked within the top ten in the “China’s Best Hospital Specialty Rankings” by the Hospital Management Institute of Fudan University in the past five years.

12. Current or former holders of positions at the D-level or above in the United Nations Secretariat, United Nations specialized agencies, other intergovernmental international organizations, or particularly significant non-governmental international organizations.

13. Current or former holders of positions as Vice Presidents, Vice Chairpersons or above in international tourism organizations such as the Universal Federation of Travel Agents’ Associations (UFTAA), World Association of Travel Agencies (WATA), International Association of Tourism (IAT), and Alliance Internationale de Tourisme (AIT); current or former Presidents or Chairpersons of national tourism associations such as the China Tourism Association and the China Tourism Automobile and Cruise Association.

14. Individuals who, within the past five years, have obtained doctoral degrees from world-renowned universities ranked in the top 150 (according to the latest rankings in the application year) in the U.S. News & World Report Best Global Universities Rankings, QS World University Rankings, Times Higher Education (THE) World University Rankings, or Academic Ranking of World Universities (ARWU), came to work in the Guangdong-Macao In-Depth Cooperation Zone in Hengqin, signed a labor contract with the employer for more than three years, and achieved relatively outstanding results in scientific and technological innovation, transformation of scientific and technological achievements, or industrial implementation.

18. Principal leaders of teams that won first, second, or third place in the China Innovation & Entrepreneurship Competition; principal leaders of teams that won first place in the China Innovation & Entrepreneurship Competition (Provincial Division); leaders of project teams that won gold medals in the National Postdoctoral Innovation and Entrepreneurship Competition.
