Regulations on the Practice of Medical Personnel from the Macao Special Administrative Region in the Guangdong-Macao In-Depth Cooperation Zone in Hengqin

Article 1. In order to promote the construction of the Guangdong-Macao In-Depth Cooperation Zone in Hengqin (hereinafter referred to as the Cooperation Zone) and facilitate medical personnel from the Macao Special Administrative Region (hereinafter referred to as Macao) to provide services conveniently and in an orderly manner in the Cooperation Zone, the regulations herein are formulated in accordance with the basic principles of relevant laws and regulations, as well as the "Outline Development Plan for the Guangdong-Hong Kong-Macao Greater Bay Area", the "Master Plan of the Development of the Guangdong-Macao In-Depth Cooperation Zone in Hengqin", and the "Regulations on the Promotion of the Development of the Guangdong-Macao In-Depth Cooperation Zone in Hengqin", taking into account the actual situation of the Cooperation Zone.

Article 2. Macao medical personnel registered according to the regulations herein may provide medical services in the Cooperation Zone that are consistent with their Macao medical personnel qualification certificates.

Article 3. Macao medical personnel providing services in the Cooperation Zone according to the regulations herein shall simultaneously meet the following conditions:

(1) Holding Macao resident status;

(2) Possessing a valid Macao medical personnel qualification certificate;

(3) Being included in the application scope of Macao "Professional Certification and Practice Registration System for Medical Personnel", mainly including doctor, dentist, Chinese medicine practitioner, pharmacist, Chinese herbalist, nurse, medical laboratory technician, radiologist, chiropractor, physical therapist, occupational therapist, speech therapist, psychotherapist, nutritionist and pharmacy technical assistant;

(4) Having engaged in relevant practice in Macao for at least two years;

(5) Being not in a situation prohibited by laws and administrative regulations from engaging in medical and health services.

Article 4. Macao medical personnel registered according to the regulations herein shall be employed by legally established medical institutions and only provide medical services within the Cooperation Zone.

Article 5. Before providing medical services in the Cooperation Zone, Macao medical personnel shall apply for registration with the health department of the Cooperation Zone or, in writing, entrust the employing medical institution to apply on their behalf, and submit materials according to the registration management measures.

The registration management measures are separately formulated by the health department of the Cooperation Zone.

Article 6. The health department of the Cooperation Zone shall review the application materials within twenty days from the date of accepting the registration application. If the application is deemed qualified upon review, registration and the issuance of a practice certificate shall be granted. The practice certificate shall specify the practice location, practice category, practice scope, and practice duration.

For those not granted registration due to the failure to meet the conditions, the health department of the Cooperation Zone shall, within twenty days from the date of accepting the registration application, inform the employing institution and the applicant in writing and state the reasons.

Macao medical personnel who are not registered with the health department of the Cooperation Zone are not allowed to provide medical services in the Cooperation Zone.

Article 7. The validity period of registration shall be the same as the time when Macao medical personnel are employed by medical institutions, with a maximum of three years. After expiration, it can be renewed.

If Macao medical personnel change their practice location, category, and/or scope under their registration, they shall apply for the change with the health department of the Cooperation Zone.

Article 8. Registered Macao medical personnel shall practice in the Cooperation Zone in accordance with the relevant laws, regulations, and rules on medical, health, and pharmaceutical management, as well as those on diagnosis, treatment, and nursing care in the Chinese mainland. They shall engage in relevant practice activities according to the practice location, category, scope, and duration specified in their practice certificates, and undergo regular assessments according to relevant regulations.

Medical institutions shall establish and enhance rules and regulations and strengthen the management and training of Macao medical personnel. They shall not deploy unregistered Macao medical personnel for relevant practice activities or arrange Macao medical personnel for engagement in practice activities that exceed the practice location, category, scope, and duration specified in their practice certificates.

Article 9. Macao doctors, Chinese medicine practitioners, and dentists who have obtained practice certificates in the Cooperation Zone have the right to prescribe in their medical institutions within the Cooperation Zone. Other Macao medical personnel practicing in the Cooperation Zone do not have prescription rights.

Article 10. Registered Macao medical personnel shall participate in continuing medical education and training as required. The health department of the Cooperation Zone shall include registered Macao medical personnel in continuing medical education and training.

Medical institutions shall ensure that Macao medical personnel practicing in their institutions receive continuing medical education and training.

Registered Macao medical personnel who participate in continuous professional development activities in Macao and obtain the specified credits shall be recognized by the health department of the Cooperation Zone.

Article 11. Macao Chinese medicine practitioners, with at least five years of clinical experience in Macao, are eligible to apply for establishing a Chinese medicine clinic and practicing in the Cooperation Zone. The health department of the Cooperation Zone shall accept and process the application in accordance with the relevant provisions for establishing a Chinese medicine clinic.

Article 12. Registered Macao medical personnel who have practiced in the Cooperation Zone for at least one year are eligible to apply to the health department of the Cooperation Zone to engage in corresponding practice activities in medical institutions within the Cooperation Zone, other than their primary practice institutions, with the consent of their primary practice institutions.

Article 13. The health department and comprehensive law enforcement department of the Cooperation Zone shall, in accordance with relevant laws, regulations, and rules in the Chinese mainland, supervise and manage the practice activities of registered Macao medical personnel in the Cooperation Zone.

Article 14. Macao medical personnel who provide medical services in the Cooperation Zone without registration, or registered Macao medical personnel who do not adhere to the practice location, category, scope, and duration specified in their practice certificates, shall be punished according to the "Physician Law of the People's Republic of China", "Nurse Regulations", and/or "Regulations on the Management of Medical Institutions".

Article 15. Medical institutions in the Cooperation Zone that use unregistered Macao medical personnel or Macao medical personnel who have not obtained other legal medical practice licences to engage in relevant practice activities in the Cooperation Zone, shall be considered as using non-health professionals and shall be punished according to Article 47 of the "Regulations on the Management of Medical Institutions."

Article 16. Macao medical personnel who provide medical services in the Cooperation Zone in violation of laws, regulations, and rules shall be dealt with according to relevant regulations.

Article 17. In the event of a medical dispute during the practice of registered Macao medical personnel in the Cooperation Zone, it shall be handled in accordance with the "Regulations on the Prevention and Handling of Medical Disputes" and the "Regulations on the Handling of Medical Accidents" and other relevant regulations.

Article 18. The health department of the Cooperation Zone shall establish a management system for the practice information of Macao medical personnel.

The practice information of Macao medical personnel shall be published on the official government website of the Cooperation Zone.

Article 19. The regulations herein come into effect on August 1, 2023.
